These Terms of Service govern your access to and use of livingchat, including our website, apps, APIs, and related services. By using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Acceptance of Terms

You must comply with these Terms, our applicable policies, and any additional terms presented for specific features. If you are using the service on behalf of a company or organization, you represent that you have authority to bind that entity.

2. Description of Service

livingchat provides a unified interface for AI-powered tools and model access. Features may include chat, multi-model comparison, collaborative AI workflows, humanization, image generation, document drafting, data tools, file uploads, exports, public sharing, and other productivity features we make available over time.

3. Account Registration

You must be at least 13 years old to use the service. You are responsible for your account, your login credentials, and all activity that occurs under your account. You agree to provide accurate information and keep it up to date.

4. Subscription Plans and Billing

Plans and Features

• We may offer free, paid, trial, promotional, monthly, quarterly, or other plan structures.
• Features, quotas, model access, and pricing may differ by plan and may change over time.

Trials and Introductory Offers

If a trial or introductory offer is available, the details shown at checkout or on the pricing page will control. For livingchat, any advertised 7-day trial is a paid $1 introductory charge, not a free trial, unless we clearly say otherwise.

Trial usage may include internal cost-control thresholds for premium models, image generation, and other AI provider-backed features. If your trial usage exceeds those thresholds, you authorize us to convert your account to the paid Pro subscription early so your access can continue without interruption. When this happens, your paid Pro billing cycle begins at the early conversion time and replaces the originally scheduled post-trial conversion date; you will not be charged a second Pro subscription fee for the same conversion.

Billing and Auto-Renewal

• Paid subscriptions renew automatically unless canceled before the next billing date.
• You authorize us and our payment processor to charge your selected payment method for recurring fees, taxes, and other charges you approve.
• Billing cycles, renewal timing, and taxes will be disclosed at checkout or in your account.
• All prices are shown in U.S. dollars unless stated otherwise.

Refunds and Cancellations

You may cancel at any time, but cancellations generally take effect at the end of the current paid period unless stated otherwise. Our refund policy is described in our Refund Policy. Except where required by law or expressly stated by us, purchases are final.

Price Changes

We may change pricing, plans, or included features from time to time. When required, we will provide advance notice before changes take effect on a renewal.

5. Acceptable Use

You agree not to, and not to help others:

• use the service for unlawful, fraudulent, or abusive purposes;
• bypass or interfere with security, rate limits, access controls, or account restrictions;
• share your account in a way that violates plan terms;
• scrape, crawl, automate, or overload the service in unauthorized ways;
• upload, submit, or generate content that infringes others' rights or violates applicable law;
• reverse engineer, probe, or attempt to access systems or data you are not authorized to access.

6. AI-Generated Content

AI-generated content may be inaccurate, incomplete, offensive, misleading, or unsuitable for your intended purpose. You are responsible for reviewing, verifying, and deciding how to use any output. The service is a tool, not a substitute for professional, legal, medical, financial, or other expert advice.

7. Intellectual Property

As between you and us, you retain rights you have in your inputs. You are responsible for ensuring you have rights to submit the content you upload or prompt with. Subject to these Terms and the terms of underlying providers, you may use outputs generated for you. We retain all rights in the service itself, including software, design, marks, branding, and related intellectual property.

8. Privacy

Your use of the service is also governed by our Privacy Policy. Please review it to understand how we collect, use, and disclose information.

9. Limitation of Liability

To the maximum extent permitted by law, LIVINGCHAT and its affiliates, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, business, goodwill, data, or use. Our aggregate liability for claims relating to the service will not exceed the amount you paid us for the service during the 12 months before the event giving rise to the claim.

10. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, accuracy, or availability.

11. Termination

We may suspend, limit, or terminate your access if you violate these Terms, create risk for us or others, engage in abuse or fraud, fail to pay fees, or where required by law. You may stop using the service at any time. Sections that by their nature should survive termination will remain in effect.

12. Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict-of-laws principles. If a dispute arises, you agree to first contact us so we can try to resolve it informally. If we cannot resolve it, disputes may be handled in the forum allowed by applicable law and the version of these Terms in effect at the time of the dispute.

13. Chargebacks

If you initiate a chargeback, payment reversal, or payment dispute, we may suspend the related account while the issue is reviewed. We may provide transaction, login, usage, and subscription records to payment processors, banks, or card networks when responding to disputes.

14. Changes to Terms

We may update these Terms from time to time. When changes become effective, the updated version posted here will govern future use. If required, we may also provide notice by email, in-product notice, or other reasonable means.
